To get legal aid , you usually need to show you cannot afford to pay for legal costs and your problem is serious. You’ll usually have to give details and evidence of your income, benefits, savings. The exceptions are Alaska and Hawaii, which have higher income eligibility thresholds.


There are exceptions, so if you are unsure, go ahead and call to apply. We do not handle every kind of case. The Jurisdiction Test looks at whether legal aid is available in that jurisdiction and area of law.


The Means Test looks at your income and assets. If you are eligible , we look at how much contribution you will pay towards the cost of the service. Family allowances are disregarded. An applicant whose disposable income is less than the poverty line would be assessed at the minimum contribution level. If it is considered reasonable for a solicitor in private practice to act in expectation of costs being recovered in due course from settlement funds, then legal aid is refused.
